Substantive Policy Statement on Joint-Venture Article

Policy No. 01 - 2022

The Administrative Procedure Act requires the publication of substantive policy statements issued by agencies (A.R.S. § 41-1013(B)(14)).

Substantive policy statements are written expressions which inform the general public of an agency's current approach to a rule. This substantive policy statement is advisory only. A substantive policy statement does not include internal procedural documents that only affect the internal procedures of the agency and does not impose additional requirements or penalties on regulated parties or include confidential information or rules made in accordance with the Arizona administrative procedure act. If you believe that this substantive policy statement does impose additional requirements or penalties on regulated parties you may petition the agency under section 41-1033, Arizona Revised Statutes, for a review of the statement.

 

Purpose: This policy statement documents the authority of the Arizona Office of Tourism (AOT) to enter into joint ventures.

 

Introduction: Under A.R.S. § 41-2305 (B)(12) AOT has the authority to engage in joint ventures with private corporations to further the goals of the Office. Title 20, Chapter 3, Article 1 of the Arizona Administrative Code (A.A.C.) provides a definition, procedure, standards for participation, and conditions of participation.

 

Policy: As part of a larger policy initiative, AOT’s executive team is evaluating the rule for effectiveness.

 

Responsibility: Responsibility for this substantive policy lies with the Director of the Arizona Office of Tourism.

 

Procedures: The AOT Executive Team will discuss the current rule in relation to the office’s work and determine if a rule amendment is necessary.
